No comprehensive federal AI statute
As of mid-2026 the US has no single federal AI law. Federal AI governance runs through agency enforcement of existing laws, executive orders and voluntary guidance. The FTC is expected to issue a policy statement on how the FTC Act applies to AI, and the FCC has been directed to consider a federal AI reporting and disclosure standard that would preempt conflicting state laws, neither is in force yet.
Colorado SB 26-189
Colorado repealed and replaced its original AI law with SB 26-189, a narrower statute regulating automated decision-making technology that materially influences consequential decisions, effective 1 January 2027.
Connecticut SB 5
Connecticut's SB 5, passed in the 2026 session, is the state's most comprehensive AI legislation to date, including a regulatory sandbox, chatbot controls, and automated-decision-system transparency requiring disclosures from a developer to a deployer of an automated system.
New York City Local Law 144
NYC's Local Law 144 requires bias audits for automated employment decision tools and remains actively enforced today, not a proposal.
Illinois AI interview disclosure
Illinois requires employers to notify job candidates when AI analyses their video interviews and to obtain consent before that evaluation happens, effective February 2026.
