Terms of Service
Agreement to terms
These Terms of Service govern your access to and use of the AI Operating Map website (https://www.aioperatingmap.com) and platform (https://app.aioperatingmap.com). By accessing the website, creating an account, or purchasing access, you agree to be bound by these terms. If you do not agree, please do not use the website or platform.
AI Operating Map is operated by MOHO & Cave Pty Ltd (ABN 27 657 476 563), trading as AI Operating Map, registered in Australia. MOHO & Cave Pty Ltd also trades as Techshin Partners.
The platform
AI Operating Map is a self-serve platform that helps organisations track who owns which AI systems, what they're approved to do, and how decisions about them are made. Ongoing Organisation Access (the "Silver" tier) covers one legal organisation and its primary workspace, with unlimited internal users, for a one-off fee (tax included where applicable) and no annual platform fee, as described on the pricing page.
The platform is self-reported. You and your team enter and maintain the information it holds; it is not connected to your billing, HR, identity, or other business systems unless you separately configure an integration we offer. Nothing on the website constitutes a binding offer of a specific outcome, and all features and pricing are subject to these terms and the current pricing page.
Organisation Access is currently offered at a single tier, Silver. We may introduce additional tiers in the future, for example Gold or Platinum, bundling further integrations, AI features or services as separately priced, opt-in upgrades. Introducing a new tier does not reduce, alter, or require further payment for the inclusions of Organisation Access already purchased at the Silver tier.
Organisation Access includes Map Foundations, live group onboarding sessions run on a recurring schedule. Sessions are delivered in a group format, recordings are provided, and the schedule and format may be adjusted from time to time.
Advisory services
Techshin Partners also offers advisory engagements related to AI Operating Map, including the AI Framing Sprint, Map Guidance and Map Advisory engagements. The specific scope, duration, fees, and deliverables of any advisory engagement will be set out in a separate engagement agreement or order confirmation.
Partners
Our website may list Architect and Builder partners. Except where a partner is operated by MOHO & Cave Pty Ltd (such as Techshin Partners), partners are independent businesses. Engagements with independent partners are contracted directly between you and the partner: we are not a party to those engagements, we don't broker them, and we don't take a fee from them. A listing is not an endorsement or a warranty of a partner's services, and to the maximum extent permitted by law we are not liable for services provided by independent partners. Engagements delivered by Techshin Partners are provided by MOHO & Cave Pty Ltd under their own engagement agreements.
Accounts and access
You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for activity that occurs under your organisation's account, including actions taken by internal users you invite. Ongoing Organisation Access is licensed to one legal organisation; additional organisations, subsidiaries, or separate workspaces are priced and licensed separately.
Unlimited internal users is subject to fair use: we may apply reasonable limits where usage materially exceeds what's typical for a single organisation, and we'll contact you before doing so.
Payment
Fees are shown in Australian dollars. Ongoing Organisation Access is priced inclusive of GST where applicable; a formal tax invoice is available on request. Advisory engagements are billed as set out in the applicable engagement agreement and may be quoted exclusive of GST. Ongoing Organisation Access is a one-off payment; it does not renew or recur.
Organisation Access comes with a 30 day money back guarantee: if the platform isn't right for your organisation, email us within 30 days of purchase and we'll refund it in full. Beyond that guarantee, fees are non refundable except as required by law, including the Australian Consumer Law. Advisory engagement fees are handled as set out in the applicable engagement agreement.
Discount and referral codes
We may offer discount codes, including codes issued through our referral program. One code applies per purchase, and where more than one price could apply, the best price for you applies. Codes have no cash value, apply only to the purchases we designate, and may be modified, withdrawn or cancelled prospectively at any time. Codes may not be used on your own purchase where they were issued to you as a referrer.
Registering as a referrer is free and creates no employment, agency, partnership or joint venture with us. We don't owe referrers commissions or payments. Referrers must describe the platform accurately, consistent with our published materials, and must not make claims or promises on our behalf. We may revoke a referrer's code for misuse or misleading conduct.
Service availability and changes
We aim to keep the platform available and to maintain the content, templates, and registers it provides at a standard level, but we do not guarantee uninterrupted availability. We may update or improve the platform over time. New premium products, substantial new capabilities, and advisory services are not included in Ongoing Organisation Access unless expressly stated.
If we ever discontinue the AI Operating Map service, we will give customers at least 90 days' notice and make an export of their data available before the service ends. This is in addition to, and does not limit, any other rights you may have under these terms or Australian Consumer Law.
Acceptable use
You agree to use the website and platform only for lawful purposes and in a way that does not infringe the rights of others or restrict or inhibit anyone else's use of them. You may not attempt to gain unauthorised access to the platform or its systems, resell or sublicense access without our written permission, or use the platform to store or process content that is unlawful, defamatory, or infringes a third party's rights.
Your data
Information your organisation enters into the platform, including your operating map, registers, approvals, and records, remains your data. We do not claim ownership of it. We will treat it as confidential and use it only to provide the platform and services to you, as described in our Privacy Policy.
You're responsible for ensuring your organisation has the right to enter the information it puts into the platform, including information about your own people, and that doing so complies with the laws that apply to you.
Intellectual property
All content on the website and platform, including text, design elements, the AI Operating Map name and logo, and the underlying playbooks, templates, registers, and six-domain framework, is the intellectual property of MOHO & Cave Pty Ltd or its licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from the website or platform outside of your licensed use, without prior written permission from MOHO & Cave Pty Ltd.
Confidentiality
Any information shared during conversations or engagements will be treated as confidential by us. Specific confidentiality obligations for advisory engagements will be outlined in any formal engagement agreement.
Limitation of liability
To the maximum extent permitted by law, MOHO & Cave Pty Ltd, its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or platform. Our total liability for any claim arising from these terms is limited to the amount you have paid to us in the twelve months preceding the claim.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.
Third party links
The website and platform may contain links to third party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites or services.
Governing law
These terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from these terms or your use of the website or platform will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
Changes to these terms
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the website or platform after changes are posted constitutes acceptance of the revised terms. For material changes affecting Organisation Access, we'll take reasonable steps to notify account holders.
